Terms of Service

1. Acceptance of these terms

These Terms of Service ("Terms") govern your access to and use of the Loha CI/CD platform, website, and related services (the "Service") provided by Loha ("Loha", "we", "us").

By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you are authorized to bind that organization.

2. The Service

Loha is a multi-tenant CI/CD platform for building, testing, and deploying software, hosted entirely in Thailand. We may add, change, or remove features over time. During UAT/beta, the Service is provided on a pre-release basis and may change or be interrupted.

3. Eligibility and accounts

You must provide accurate account information and keep your credentials secure. You are responsible for all activity under your account and for the actions of users you invite to your workspaces.

New workspaces may require approval before compute resources are provisioned. We may decline, suspend, or limit accounts to protect the Service and other users.

4. Acceptable use

You agree not to use the Service to: break any applicable law or regulation; infringe the rights of others; upload or distribute malware; mine cryptocurrency or run workloads unrelated to software delivery without our written agreement; attempt to gain unauthorized access to, disrupt, or overload the Service or other tenants; circumvent security, rate limits, or usage quotas; or send spam or abusive content.

We may investigate suspected violations and remove content or suspend access where we reasonably believe these Terms have been breached.

5. Your content and intellectual property

You retain all rights to the source code, configuration, and other content you bring to the Service ("Customer Content"). You grant Loha a limited license to host, process, and transmit Customer Content solely to operate and provide the Service to you.

Loha and its licensors retain all rights to the platform itself, including its software, design, and trademarks. Open-source components remain under their respective licenses.

6. Plans, trials, and billing

Paid plans, build-minute allowances, and any trials are described on our pricing page and in your order. Fees are billed in advance and are non-refundable except where required by law. We may change pricing on prospective notice.

"Unlimited" allowances are subject to fair-use and to the acceptable-use terms above.

7. Service availability

We aim to keep the Service available and reliable but, except where a separate written service-level agreement (SLA) applies, the Service is provided without an availability guarantee. Any specific SLA is a negotiated contract term, not a marketing statement. During UAT/beta there is no SLA.

8. Disclaimer of warranties

To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. You are responsible for maintaining backups of your Customer Content.

9. Limitation of liability

To the maximum extent permitted by law, Loha will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability for any claim arising out of or relating to the Service is limited to the amount you paid us for the Service in the three months before the event giving rise to the claim.

10. Data protection and DPA

Our handling of personal data is described in our Privacy Policy. Where Loha processes personal data on your behalf as a processor, a Data Processing Agreement (DPA) is available to Enterprise customers on request at privacy@loha.longtumlab.com.

11. Suspension and termination

You may stop using the Service and delete your account at any time from your account settings. We may suspend or terminate access for breach of these Terms, risk to the Service or others, or non-payment. On termination, we will make your Customer Content available for export for a reasonable period unless prohibited by law.

12. Governing law

These Terms are governed by the laws of the Kingdom of Thailand, and the courts of Thailand have exclusive jurisdiction over any dispute, without regard to conflict-of-laws rules.

13. Changes to these terms

We may update these Terms from time to time. We will post the updated version here and, for material changes, take reasonable steps to notify you. Continued use of the Service after changes take effect means you accept the updated Terms.
